A dumb thought.

Stylistically, because it'd just look so much cooler to have one's 
commission from the Emperor than the PM...

Why not change the last sentence to read 'shall be maintained with the 
Emperor as Supreme Commander, who in all matters shall act only upon 
the advice of the Prime Minister.'

It sets the Emperor up like the British Queen; Nominally the top guy 
(so the GSDF can legitimately be called the 'Imperial Japanese Army' 
for example), but the PM de facto holds the reins.
